Passenger Says Faulty Delta Seatbelt Threw Him Into Bulkhead, Later Leaving Him With Major Medical Problems

A Wisconsin man has sued Delta Air Lines, alleging that a defective seatbelt during a landing left him unconscious after he was thrown into the aircraft’s bulkhead.

Darrin Roth says the incident happened in January 2025 while he and his wife were traveling from Tampa, Florida, to New York. According to the lawsuit described in reporting by the Milwaukee Journal Sentinel, Roth alleges that his seatbelt failed during landing and did not restrain him as the aircraft came to a stop.

He says the impact caused him to lose consciousness and resulted in injuries that required medical treatment. In the months after the incident, Roth suffered a heart attack, underwent quadruple bypass surgery and later had cervical fusion surgery.

Delta is being accused of negligence over the alleged failure to properly maintain the aircraft’s seatbelt equipment. The lawsuit seeks damages, although the amount has not been specified.

What happened to the Delta passenger?

According to Roth’s allegations, the incident occurred as the Delta flight was landing in New York after departing Tampa.

He claims that the seatbelt suddenly failed, causing him to move violently forward and strike the aircraft’s bulkhead.

Roth says he immediately lost consciousness.

Flight attendants reportedly examined the seatbelt after the incident and identified a malfunction, according to the account cited by WION.

The alleged equipment failure is now central to Roth’s lawsuit because his legal team argues that Delta had a responsibility to maintain the aircraft and its restraint systems in safe working condition.

What injuries does Roth say he suffered?

The consequences described in the lawsuit extend well beyond the initial impact.

Roth alleges that he suffered significant physical and medical problems following the incident.

According to the reported details, he subsequently experienced a heart attack and underwent quadruple bypass surgery.

He also underwent cervical fusion surgery in November 2025.

The lawsuit argues that these medical problems were connected to the January 2025 aircraft incident.

That connection, however, remains an allegation. A lawsuit is not proof that the seatbelt failure caused every subsequent medical condition, and the question of medical causation could become one of the most contested issues in the case.

Why is the seatbelt failure important?

Aircraft seatbelts are a critical safety system, particularly during takeoff, landing and unexpected turbulence.

Passengers are expected to remain restrained when the seatbelt sign is illuminated because even relatively low-speed aircraft movements can produce significant forces.

A properly functioning restraint is intended to keep a passenger in their seat and reduce the likelihood of severe impact with the aircraft interior.

If a seatbelt actually failed because of a maintenance defect, the circumstances could raise questions about whether the airline met its duty to maintain the aircraft properly.

That does not automatically establish liability, however.

The airline’s maintenance records, the condition of the belt, inspection history and evidence about how the failure occurred could all become important.

What will Roth need to prove?

The lawsuit will likely involve several separate questions.

First, Roth would need to establish that the seatbelt malfunctioned as alleged.

Second, the case could examine whether Delta knew or should reasonably have known about a defect and failed to address it.

Third, Roth would need to establish that the accident caused the injuries for which he is seeking compensation.

That third issue could be particularly significant.

An airline might accept that an accident occurred while disputing whether a particular later medical condition was caused by that accident.

The heart attack and subsequent surgeries could therefore become central to the medical evidence presented in court.

Could Delta dispute the connection to the heart attack?

Yes.

Even if a court ultimately finds that the seatbelt malfunction resulted from negligent maintenance, that would not automatically establish that every medical condition Roth later experienced was caused by the accident.

Defense attorneys could argue that the heart attack resulted from an underlying or pre-existing cardiovascular condition rather than the aircraft incident.

They could also challenge whether the accident caused or materially contributed to the need for later surgery.

Medical experts could therefore play an important role in determining the extent of damages.

What is the “eggshell skull” rule?

The legal concept sometimes called the eggshell skull rule could become relevant if the case proceeds to a damages determination.

The principle generally means that a defendant may be responsible for the full extent of harm caused by its wrongful conduct even when the victim has an unusually vulnerable condition that makes the resulting injury more severe than would normally be expected.

For example, if a person has an undisclosed medical vulnerability and a negligent act triggers unusually serious consequences, the defendant generally cannot simply argue that a healthier person would have suffered less harm.

But the rule does not eliminate the requirement to prove causation.

Roth would still need evidence showing that the accident caused or contributed to the injuries for which he seeks compensation.

Does New York’s no-fault insurance system apply?

The WION report raises New York’s no-fault insurance system, but that issue should be treated carefully.

New York’s no-fault automobile insurance system generally concerns injuries arising from the use or operation of motor vehicles.

An injury occurring aboard a commercial aircraft does not simply become a New York no-fault automobile claim because the aircraft landed in New York.

Aviation accidents are governed by a different legal framework, including federal aviation regulations and applicable state and federal tort law.

The precise legal claims in Roth’s lawsuit and the jurisdiction handling them should therefore be checked against the actual court complaint before making definitive statements about which insurance rules apply.

What could happen if Delta is found responsible?

If Roth establishes negligence and causation, damages could potentially include compensation for medical expenses and other losses recognized under applicable law.

Depending on the evidence, damages could potentially involve:

  • Past medical expenses
  • Future medical treatment
  • Lost income
  • Reduced earning capacity
  • Physical pain and suffering
  • Emotional distress
  • Other legally recoverable losses

The amount would depend heavily on the evidence presented in court.

Because Roth is seeking an unspecified amount, there is currently no reliable basis for predicting the value of the claim.

Why aircraft maintenance records could matter

A major question in any alleged aircraft-equipment failure is whether the airline followed required inspection and maintenance procedures.

Modern commercial aircraft undergo extensive maintenance and inspection programs.

If a seatbelt failed because of a sudden and unforeseeable defect despite proper inspections, Delta could have a different legal position from a situation in which the airline knew about a defective component and failed to repair it.

Records could therefore become crucial.

Investigators and attorneys could examine maintenance logs, inspection reports, previous defect reports and the aircraft’s service history.

The physical seatbelt itself could also provide important evidence if it was preserved and examined.

Could the flight crew be involved?

The reported allegations focus primarily on the alleged failure and maintenance of the seatbelt rather than deliberate conduct by the flight crew.

According to the account, flight attendants examined the belt after Roth was injured and recognized that something was wrong.

That could become relevant evidence if their observations are documented.

But the fact that crew members discovered a malfunction after an accident does not by itself establish when the defect developed or whether Delta should have discovered it earlier.

Those questions would require technical and maintenance evidence.

Why is this case unusual?

Passenger injury lawsuits involving airlines are not unusual.

What makes Roth’s case particularly notable is the alleged sequence of events: a restraint failure during landing, an immediate loss of consciousness and then serious medical problems that allegedly continued for months.

The lawsuit therefore raises two different issues.

The first is straightforward: did an aircraft safety restraint fail?

The second is considerably more complicated: how much of Roth’s subsequent medical history can legally be attributed to that failure?

That second question could determine a substantial portion of any potential damages.

What happens next?

The case will have to work through the normal litigation process.

Evidence could include medical records, aircraft maintenance documents, witness testimony, photographs or physical evidence involving the seatbelt, and expert testimony about both aviation safety and medical causation.

Delta will have an opportunity to respond to Roth’s allegations and present its own evidence.

Until a court reaches a decision, the allegations against the airline remain disputed.

The same caution applies to the claim that the seatbelt incident caused Roth’s heart attack and later surgeries.

The bigger picture

Aircraft seatbelts are among the simplest-looking pieces of equipment on a commercial airplane, but their reliability is fundamental to passenger safety.

Roth’s lawsuit places an alleged failure of that basic safety system at the center of a much larger legal dispute.

The case is not simply about whether a seatbelt broke.

It could ultimately turn on three questions: whether Delta was negligent, whether the airline’s maintenance practices contributed to the failure, and whether the alleged failure caused the full extent of Roth’s subsequent medical problems.

Those questions will require evidence rather than headlines.

For now, Roth is seeking compensation from Delta over the January 2025 incident, while the airline will have the opportunity to contest the allegations in court.
