Indian Tech Worker on H-1B Visa Sues US Employer for Forced Labor, Wage Theft, and Caste Bias

After completing his studies, he initially worked for another New Jersey-based firm, E-Content, before joining SiriSoft in 2018. The company allegedly promised to sponsor his H-1B visa and future Green Card, a crucial step toward permanent US residency, but used that promise as leverage.

The complaint states that SiriSoft threatened Vallabhaneni with deportation if he resisted unfair working conditions, forcing him to work without full pay and cover portions of his own salary for six months, a clear violation of federal labor laws.

“Forced labor, labor trafficking, and the retention of visa documents are criminal offenses,” the lawsuit asserts.

“This Resembles a Squid Game,” Says Labor Trafficking Expert

Jay Palmer, a well-known labor trafficking consultant who helped prepare Vallabhaneni’s case, compared the situation faced by many Indian H-1B workers to a grim survival game.

“For Indian workers, this resembles a Squid Game where the primary objective is to remain in America,” Palmer told Breitbart News.

He further criticized what he described as a culture of exploitation perpetuated by certain Indian-origin executives in US tech firms, alleging that some import caste-based discrimination into the workplace.

“Indian CEOs bring the caste-discrimination politics from their home country into workplaces in the United States,” he said.

Palmer, who has investigated numerous labor trafficking cases, claims the H-1B visa program is being abused by staffing firms that profit from vulnerable migrant workers’ immigration dependency.

Wage Theft and Life Under Pressure

Vallabhaneni’s lawsuit alleges that SiriSoft consistently violated Department of Labor regulations by paying him less than the legally mandated prevailing wage for his role.

Despite being guaranteed a certain salary under H-1B visa rules, he often received just enough to cover rent and basic expenses. Irregular payments caused him to lose health insurance, miss credit payments, and forgo medical care for himself and his wife, even during a serious leg injury.

The company’s control extended beyond finances. SiriSoft allegedly refused to release him from employment despite repeated violations, threatening to revoke his visa if he attempted to leave.

“They used my Green Card process as a weapon,” Vallabhaneni reportedly stated in his complaint.

What the Lawsuit Seeks

Filed in a US federal court, the lawsuit demands:

  • Compensatory and punitive damages
  • Payment of back wages
  • Legal fees
  • A jury trial to determine restitution and liability

“These reprehensible actions constitute forced labor and labor trafficking via the H-1B visa program,” the complaint reads.

As of now, Siri Software Solutions has not publicly responded to the allegations or to Breitbart News’ requests for comment.

The Larger Picture: Visa Dependency and Exploitation

Vallabhaneni’s case sheds light on a deeper issue: the vulnerability of H-1B workers who depend on employers for their legal status in the US.

Under US immigration law, the employer controls the worker’s visa, meaning termination often results in immediate loss of legal status and possible deportation. This imbalance gives companies significant leverage, sometimes leading to exploitative conditions.

Legal experts have long argued that this dependency enables forms of modern-day indentured labor, particularly among foreign tech professionals from India, who comprise the majority of H-1B visa holders.

Why This Case Matters

The lawsuit’s inclusion of caste-based discrimination and labor trafficking allegations makes it particularly significant. It not only raises questions about immigration abuse but also about how cultural hierarchies from South Asia are reproduced in American workplaces.

If proven, the case could prompt closer federal scrutiny of small and mid-sized staffing firms that employ H-1B workers, and possibly spur reform in how visa-dependent employees are protected.
