Menendez brothers, jailed for killing parents, resentenced, eligible for parole after 35 years

In a dramatic turn for one of America’s most notorious murder cases, a Los Angeles judge has reduced the sentences of Erik and Lyle Menendez, potentially paving the way for their release after more than three decades behind bars for killing their parents in 1989.

Historic ruling offers path to parole

Judge Michael Jesic delivered the monumental decision Tuesday, resentencing the brothers from life without parole to 50 years to life imprisonment, making them eligible for an upcoming parole hearing. The brothers, now 54 and 57, have been incarcerated since 1990 for the shotgun murders of their parents, Jose and Kitty Menendez, in their Beverly Hills mansion.

“Today is a great day,” defense attorney Mark Geragos told reporters outside the courthouse. “We are one huge step closer to bringing the boys home.”

The resentencing marks a significant development in a case that has deeply divided public opinion for decades. While prosecutors have consistently portrayed the brothers as calculating killers who murdered their wealthy parents for inheritance money, defense attorneys have maintained they acted out of self-defense after years of sexual abuse.

Brothers offer emotional apology for “unfathomable” actions

During Tuesday’s hearing, both brothers delivered emotional statements to the court, acknowledging the brutality of their crimes and expressing remorse.

“I had to stop being selfish and immature to really understand what my parents went though in those last moments,” Erik Menendez told the court, describing the “shock, confusion and betrayal” his parents must have felt when their sons opened fire.

Lyle Menendez’s voice cracked as he addressed family members, saying: “I lied to you and forced you into a spotlight of public humiliation.”

Prison rehabilitation efforts cited in decision

Judge Jesic called the brothers’ work while in prison “remarkable,” noting their extensive educational achievements and programs they created to improve inmates’ lives, including a hospice initiative for elderly and sick prisoners.

Family members and associates testified about the brothers’ rehabilitation. Anamaria Baralt, the brothers’ cousin who has remained close with them since childhood, told the court they deserved a “second chance at life.”

“It’s been a nightmare,” she said. “I am desperate for this process to be over.”

The court also heard from unexpected supporters, including a retired Florida judge who stated he had never previously testified on behalf of any criminal defendant, and Anerae “X-Raided” Brown, a rapper who credits the Menendez brothers for helping secure his own release from prison.

Prosecutors oppose release, questioning rehabilitation

Los Angeles County District Attorney Nathan Hochman, who argued against resentencing, maintained that the brothers have not fully rehabilitated and continue to “make excuses” rather than take complete responsibility for their crimes.

“There’s no doubt they’ve done all these positive things in prison,” Deputy District Attorney Habib Balian said in his closing argument. But when reversing a jury’s unanimous verdict in such a brutal murder case, it’s essential to “make certain they are truly rehabilitated.”

Prosecutors questioned witnesses about what they characterized as a “litany of lies” the brothers have maintained since the murders, including deceptions to law enforcement, family members, and during their trials.

Case returns to national spotlight

The decades-old case has experienced renewed public interest following Netflix’s “Monsters: The Lyle and Erik Menendez Story” and the release of another docudrama, “The Menendez Brothers.” The renewed attention introduced the case to a younger generation and garnered support from celebrities including Kim Kardashian and Rosie O’Donnell, who have advocated for the brothers’ release.

Former Los Angeles District Attorney George Gascón had previously supported their resentencing bid, enabling Tuesday’s hearing to proceed.

What lies ahead: Parole board to decide

The brothers’ fate now rests with the California parole board, which has already been evaluating them following a request from Governor Gavin Newsom. A risk assessment has been completed as part of their separate request for clemency, with prosecutors indicating it showed a “moderate risk of violence,” though the full report remains unreleased.

The state’s parole board is scheduled to conduct a hearing on June 13 to determine whether the brothers pose a risk to public safety if released.

Newsom is separately considering a clemency request that could potentially result in a reduced sentence or pardon.

As the brothers smiled and waved to attorneys and family members following Tuesday’s decision, their cousin expressed cautious optimism: “It is a difficult process,” Baralt said of the upcoming parole hearing, “but we will eagerly step through those doors if it means we can have them home.
