Ohio Supreme Court rules "boneless wings" can contain bones

Controversial Decision Stems from Choking Incident

The Ohio Supreme Court has made a surprising ruling that diners who order “boneless chicken wings” cannot expect the meat to be entirely free of bones. This decision has sparked significant debate and stems from a serious choking incident involving a restaurant patron.

The incident

Michael Berkheimer, the plaintiff, suffered severe medical complications eight years ago after getting a bone stuck in his throat while eating what he believed to be boneless chicken wings at Wings on Brookwood. Following this incident, Berkheimer sued the restaurant, along with the supplier and farm where the chicken was sourced, claiming that he was not adequately warned about the potential presence of bones in the “boneless wings.”

The court’s ruling

In a 4-3 decision, the Ohio Supreme Court ruled against Berkheimer, asserting that “boneless wings” refer to the cooking style rather than a guarantee that the meat is free of bones. Justice Joseph T. Deters, writing for the majority, stated, “A diner reading ‘boneless wings’ on a menu would no more believe that the restaurant was warranting the absence of bones in the items than believe that the items were made from chicken wings, just as a person eating ‘chicken fingers’ would know that he had not been served fingers.” The court maintained that it is common knowledge that chickens have bones, and patrons should be aware of this fact.

Dissenting opinions

The ruling was met with strong dissent. Some justices argued that labeling a dish as “boneless wings” should indeed imply that the dish is free of bones. Justice Michael P. Donnelly, in his dissent, called the majority’s reasoning “utter jabberwocky.” He argued that the term “boneless” should be straightforward, meaning without bones, and that this is the reasonable expectation of consumers, especially parents who feed their young children such products.

Reactions

The decision has opened up a broader discussion about the labeling of food items and consumer expectations. The divided ruling highlights the challenges courts face in balancing legal interpretations with common consumer perceptions.

The Ohio Supreme Court’s ruling that “boneless chicken wings” can legally contain bones has stirred controversy and debate. While the court sided with the notion that “boneless wings” is a description of cooking style, dissenting voices argue for clearer and more honest labeling to protect consumers. The case has set a precedent that may influence future disputes over food labeling and consumer rights.
